1. About these terms

AvadaBD (avadabd.com) is an online marketplace operated by AvadaBD, Naogaon, Dhaka, Bangladesh, trade licence no. [6412877210010]. By creating an account, placing an order or otherwise using our website or app, you agree to these terms and to the policies listed in section 17. If you do not agree, please do not use the site.

You must be at least 18 years old and able to enter into a binding contract under the laws of Bangladesh to place an order.

2. Who you are buying from

AvadaBD is a marketplace. The products on this site are sold by independent vendors, not by AvadaBD. The vendor's name appears on every listing under "Sold by".

When you place an order, the contract of sale is between you and that vendor. AvadaBD provides the platform, takes online payments on the vendor's behalf, coordinates the ordering and delivery process, and helps resolve complaints as described in section 13. The vendor is responsible for the product, its description, the warranty and returns.

Vendors are reviewed when they apply to sell on AvadaBD. That review is not an inspection of every product, and we do not promise that any listing is free of error.

3. Used and refurbished products

Most products on AvadaBD are pre-owned. A used product shows normal signs of use, and its battery, screen and other parts may not perform like new ones. Every listing states the condition of the product, and each vendor must describe what is actually being sold. Please read the listing and our Used Device Policy before you order.

4. Your account

• Give accurate information and keep it up to date.

• Keep your password and one-time codes private. You are responsible for activity on your account.

• One person, one account. We may suspend or close an account used for fraud, fake orders, abuse of returns, or harassment of vendors or delivery staff.

• For your protection, repeated wrong-password attempts temporarily lock the account.

5. Prices and product information

Prices are in Bangladeshi Taka (BDT) and are set by vendors. The total you pay is the total shown at checkout before you confirm your order. If a price or description is plainly wrong, the vendor or AvadaBD may cancel the order, and you will receive back everything you paid.

6. Placing an order

Your order becomes a confirmed order only when (a) your advance or full payment is received and (b) the vendor confirms the item is available. Until then we may decline or cancel it — for example because the item is out of stock — and you will be refunded under the Return & Refund Policy. If a vendor cannot deliver an order you have paid for, we will tell you within 48 hours and refund what you paid within the following 72 hours.

If your cart contains products from more than one vendor, they are separate orders with separate deliveries and separate delivery charges.

7. Payment

• Cash on delivery with an advance. To confirm a cash-on-delivery order you pay an advance online. It is currently 5% of the price, and the percentage shown at checkout is the one that applies to your order. You pay the rest, and any delivery charge, in cash to the delivery person when you receive the product. The advance is part of the price.

• Full online payment. You can instead pay the full amount online.

• Online payments are made through bKash, Nagad or the other methods shown at checkout. Your wallet PIN and card details are entered on the provider's own page. AvadaBD never sees or stores them.

• If you are charged twice, or a payment fails but money leaves your account, contact us at once with the transaction ID.

The rules for refunding the advance are in the Return & Refund Policy.

8. Delivery and inspection

Delivery is described in the Delivery Policy. When your order arrives, check the outer package, the seals and the number of items with the delivery person present. To protect your right to return a product or claim a defect, record an unboxing video as described in the Return & Refund Policy.

9. Returns, refunds and warranty

We do not accept returns for change of mind. A product can be returned if it arrives wrong, damaged, not working or not as described, and you report it within 72 hours of delivery, as set out in the Return & Refund Policy. Faults that appear later are handled under the Warranty Policy, which states the warranty period for each product. The vendor deals with return and warranty claims. AvadaBD supports you if a claim is not handled fairly (section 13).

10. Prohibited conduct

You must not:

• place fake or repeated orders you do not intend to accept;

• give false delivery or contact details;

• submit a false, edited or misleading claim or video;

• abuse, threaten or harass vendors, delivery staff or our team;

• use the site for anything unlawful, interfere with its security, or scrape it; or

• post false reviews.

We may cancel orders, restrict cash on delivery, suspend accounts, or report unlawful conduct to the authorities.

11. Reviews and content

Reviews must be honest and based on your own experience. We may remove content that is unlawful, abusive or false. Vendors cannot delete reviews of their products.

12. Our responsibility

We will provide the platform with reasonable care and skill. To the fullest extent the law allows:

• we are not the seller, and we are not responsible for a vendor's products, descriptions, warranty or returns, which are the vendor's responsibility under these terms and our policies;

• we are not liable for indirect or consequential loss, or for delays and losses caused by events outside our reasonable control, such as courier disruption, strikes, floods or network outages; and

• our total liability to you for anything arising from your use of the site is limited to the amount you paid for the order concerned.

Nothing in these terms excludes or limits any liability, or any right you have, that cannot be excluded or limited under the laws of Bangladesh — including your rights under the Consumer Rights Protection Act, 2009 and the Sale of Goods Act, 1930 — or any liability for fraud, or for death or personal injury.

13. Complaints and disputes

If something goes wrong, contact the vendor first through your order page. If you are not satisfied, or the vendor does not respond, complain to us at [email protected] or 01893-009370. We acknowledge every complaint within 72 hours, ask the vendor for a written response, and review whether the vendor applied the published policy and the evidence fairly. Where a vendor's decision depends on a technical inspection of the product, that inspection is the vendor's to make, but we can require the vendor to re-examine the product and explain its reasons.

14. Privacy and cookies

How we use your information is set out in our Privacy Policy and Cookie Policy.

15. Changes to these terms

We may update these terms. The updated version applies to orders placed after it is published. An order you have already placed stays under the terms that applied when you placed it. We will announce important changes on the site.

16. Governing law

These terms are governed by the laws of the People's Republic of Bangladesh.

17. Other policies, and which one prevails

These policies form part of these terms: the Privacy Policy, Cookie Policy, Warranty Policy, Return & Refund Policy, Delivery Policy, Pre-Order Policy and Used Device Policy. If one of them deals specifically with a subject, it prevails over these general terms for that subject. If the English and Bangla versions of any document differ, the Bangla version prevails.

১. এই শর্তাবলী সম্পর্কে

AvadaBD (avadabd.com) একটি অনলাইন মার্কেটপ্লেস, যা পরিচালনা করে AvadaBD, নওগাঁ, ঢাকা, ট্রেড লাইসেন্স নং [6412877210010].। অ্যাকাউন্ট খোলা, অর্ডার করা বা আমাদের ওয়েবসাইট বা অ্যাপ ব্যবহার করার মাধ্যমে আপনি এই শর্তাবলী এবং ধারা ১৭-তে উল্লিখিত নীতিমালাগুলো মেনে নিচ্ছেন। সম্মত না হলে অনুগ্রহ করে সাইটটি ব্যবহার করবেন না।

অর্ডার করতে হলে আপনার বয়স কমপক্ষে ১৮ বছর হতে হবে এবং বাংলাদেশের আইনে চুক্তি করার সক্ষমতা থাকতে হবে।

২. আপনি কার কাছ থেকে কিনছেন

AvadaBD একটি মার্কেটপ্লেস। এই সাইটের পণ্যগুলো স্বতন্ত্র ভেন্ডররা বিক্রি করেন, AvadaBD নয়। প্রতিটি লিস্টিংয়ে "Sold by"-এর নিচে ভেন্ডরের নাম দেখানো থাকে।

আপনি অর্ডার করলে ক্রয়-বিক্রয়ের চুক্তি হয় আপনার ও ওই ভেন্ডরের মধ্যে। AvadaBD প্ল্যাটফর্ম সরবরাহ করে, ভেন্ডরের পক্ষে অনলাইন পেমেন্ট গ্রহণ করে, অর্ডার ও ডেলিভারি প্রক্রিয়া সমন্বয় করে এবং ধারা ১৩ অনুযায়ী অভিযোগ নিষ্পত্তিতে সহায়তা করে। পণ্য, তার বিবরণ, ওয়ারেন্টি ও ফেরতের দায়িত্ব ভেন্ডরের।

ভেন্ডররা আবেদনের সময় যাচাই করা হয়। এই যাচাই প্রতিটি পণ্যের পরিদর্শন নয়, এবং কোনো লিস্টিং ত্রুটিমুক্ত বলে আমরা নিশ্চয়তা দিই না।

৩. ব্যবহৃত (ইউজড) ও রিফার্বিশড পণ্য

AvadaBD-র অধিকাংশ পণ্য ব্যবহৃত। ব্যবহৃত পণ্যে স্বাভাবিক ব্যবহারের চিহ্ন থাকে, এবং এর ব্যাটারি, স্ক্রিন বা অন্যান্য যন্ত্রাংশ নতুন পণ্যের মতো কাজ নাও করতে পারে। প্রতিটি লিস্টিংয়ে পণ্যের অবস্থা উল্লেখ থাকে এবং ভেন্ডরকে বাস্তবে যা বিক্রি হচ্ছে তা-ই বর্ণনা করতে হয়। অর্ডারের আগে লিস্টিং এবং আমাদের ইউজড ডিভাইস নীতি মন দিয়ে পড়ুন।

৪. আপনার অ্যাকাউন্ট

• সঠিক তথ্য দিন এবং তা হালনাগাদ রাখুন।

• পাসওয়ার্ড ও ওয়ান-টাইম কোড গোপন রাখুন। আপনার অ্যাকাউন্টের কার্যক্রমের দায়িত্ব আপনার।

• এক ব্যক্তি, একটি অ্যাকাউন্ট। প্রতারণা, ভুয়া অর্ডার, ফেরত-সুবিধার অপব্যবহার, অথবা ভেন্ডর বা ডেলিভারি কর্মীকে হয়রানির জন্য ব্যবহৃত অ্যাকাউন্ট আমরা স্থগিত বা বন্ধ করতে পারি।

• আপনার সুরক্ষার জন্য, বারবার ভুল পাসওয়ার্ড দিলে অ্যাকাউন্ট সাময়িকভাবে লক হয়ে যায়।

৫. মূল্য ও পণ্যের তথ্য

মূল্য বাংলাদেশি টাকায় (BDT) এবং ভেন্ডর তা নির্ধারণ করেন। অর্ডার নিশ্চিত করার আগে চেকআউটে যে মোট মূল্য দেখানো হয়, সেটিই আপনার পরিশোধযোগ্য মোট। কোনো মূল্য বা বিবরণ স্পষ্টতই ভুল হলে ভেন্ডর বা AvadaBD অর্ডার বাতিল করতে পারে; সেক্ষেত্রে আপনি যা পরিশোধ করেছেন তার সবটুকু ফেরত পাবেন।

৬. অর্ডার দেওয়া

আপনার অর্ডার নিশ্চিত অর্ডারে পরিণত হয় কেবল তখনই, যখন (ক) আপনার অগ্রিম বা পূর্ণ পেমেন্ট আমরা পাই এবং (খ) ভেন্ডর পণ্যটি মজুত আছে বলে নিশ্চিত করেন। তার আগে আমরা অর্ডার প্রত্যাখ্যান বা বাতিল করতে পারি — যেমন পণ্য মজুত না থাকলে — এবং ফেরত ও রিফান্ড নীতি অনুযায়ী আপনাকে টাকা ফেরত দেওয়া হবে। পেমেন্ট করা অর্ডার ভেন্ডর ডেলিভারি দিতে না পারলে আমরা ৪৮ ঘণ্টার মধ্যে আপনাকে জানাব এবং এর পরবর্তী ৭২ ঘণ্টার মধ্যে আপনার পরিশোধিত টাকা ফেরত দেব।

আপনার কার্টে একাধিক ভেন্ডরের পণ্য থাকলে সেগুলো আলাদা অর্ডার — আলাদা ডেলিভারি ও আলাদা ডেলিভারি চার্জসহ।

৭. পেমেন্ট

• অগ্রিমসহ ক্যাশ অন ডেলিভারি। ক্যাশ অন ডেলিভারি অর্ডার নিশ্চিত করতে আপনি অনলাইনে অগ্রিম দেন। বর্তমানে এটি পণ্যমূল্যের ৫%, এবং চেকআউটে যে শতাংশ দেখানো হয় সেটিই আপনার অর্ডারে প্রযোজ্য। বাকি টাকা এবং ডেলিভারি চার্জ পণ্য বুঝে পাওয়ার সময় ডেলিভারি ম্যানকে নগদে দেবেন। অগ্রিম পণ্যমূল্যেরই অংশ।

• পূর্ণ অনলাইন পেমেন্ট। চাইলে আপনি পুরো টাকা অনলাইনে পরিশোধ করতে পারেন।

• অনলাইন পেমেন্ট হয় bKash, Nagad বা চেকআউটে দেখানো অন্যান্য মাধ্যমে। ওয়ালেট পিন ও কার্ডের তথ্য পেমেন্ট প্রদানকারীর নিজস্ব পেজেই দেওয়া হয়; AvadaBD তা দেখে না বা সংরক্ষণ করে না।

• দুইবার টাকা কাটা গেলে, অথবা পেমেন্ট ব্যর্থ হলেও অ্যাকাউন্ট থেকে টাকা কেটে নিলে, ট্রানজ্যাকশন আইডিসহ দ্রুত আমাদের জানান।

অগ্রিম ফেরতের নিয়ম ফেরত ও রিফান্ড নীতিতে আছে।

৮. ডেলিভারি ও পণ্য পরীক্ষা

ডেলিভারির নিয়ম ডেলিভারি নীতি-তে বর্ণিত। পণ্য পৌঁছালে ডেলিভারি ম্যানের উপস্থিতিতে বাইরের প্যাকেজ, সিল ও পণ্যের সংখ্যা পরীক্ষা করুন। ফেরত বা ত্রুটির দাবির অধিকার রক্ষায় ফেরত ও রিফান্ড নীতিতে বর্ণিত পদ্ধতিতে আনবক্সিং ভিডিও রেকর্ড করুন।

৯. ফেরত, রিফান্ড ও ওয়ারেন্টি

আমরা মন বদলানোর কারণে ফেরত নিই না। পণ্য ভুল, ক্ষতিগ্রস্ত, অচল বা বর্ণনার সঙ্গে অমিল অবস্থায় এলে এবং ডেলিভারির ৭২ ঘণ্টার মধ্যে জানালে তা ফেরত নেওয়া যায়, ফেরত ও রিফান্ড নীতি অনুযায়ী। পরে দেখা দেওয়া ত্রুটি ওয়ারেন্টি নীতি-র আওতায় নিষ্পত্তি হয়, যেখানে প্রতিটি পণ্যের ওয়ারেন্টির মেয়াদ উল্লেখ থাকে। ফেরত ও ওয়ারেন্টি দাবি ভেন্ডর নিষ্পত্তি করেন। কোনো দাবি ন্যায্যভাবে নিষ্পত্তি না হলে AvadaBD আপনাকে সহায়তা করে (ধারা ১৩)।

১০. নিষিদ্ধ আচরণ

আপনি এগুলো করবেন না:

• নেওয়ার ইচ্ছা নেই এমন ভুয়া বা বারবার অর্ডার;

• ভুল ডেলিভারি বা যোগাযোগের তথ্য প্রদান;

• মিথ্যা, সম্পাদিত বা বিভ্রান্তিকর দাবি বা ভিডিও জমা;

• ভেন্ডর, ডেলিভারি কর্মী বা আমাদের টিমকে গালিগালাজ, হুমকি বা হয়রানি;

• বেআইনি কাজে সাইট ব্যবহার, এর নিরাপত্তায় হস্তক্ষেপ বা স্ক্র্যাপিং; অথবা

• মিথ্যা রিভিউ প্রদান।

এমন হলে আমরা অর্ডার বাতিল, ক্যাশ অন ডেলিভারি সীমিত, অ্যাকাউন্ট স্থগিত অথবা বেআইনি আচরণ কর্তৃপক্ষকে জানাতে পারি।

১১. রিভিউ ও কনটেন্ট

রিভিউ হতে হবে সৎ এবং আপনার নিজের অভিজ্ঞতাভিত্তিক। বেআইনি, আপত্তিকর বা মিথ্যা কনটেন্ট আমরা সরিয়ে ফেলতে পারি। ভেন্ডর তাদের পণ্যের রিভিউ মুছে ফেলতে পারেন না।

১২. আমাদের দায়

আমরা যুক্তিসঙ্গত যত্ন ও দক্ষতার সঙ্গে প্ল্যাটফর্ম সরবরাহ করব। আইন যতটা অনুমোদন করে, তার সর্বোচ্চ সীমা পর্যন্ত:

• আমরা বিক্রেতা নই; ভেন্ডরের পণ্য, বিবরণ, ওয়ারেন্টি বা ফেরতের দায় ভেন্ডরের, যা এই শর্তাবলী ও আমাদের নীতিমালা অনুযায়ী নির্ধারিত;

• পরোক্ষ বা আনুষঙ্গিক ক্ষতির জন্য, এবং আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরের ঘটনা — যেমন কুরিয়ার ব্যাঘাত, হরতাল-ধর্মঘট, বন্যা বা নেটওয়ার্ক বিভ্রাট — থেকে সৃষ্ট বিলম্ব বা ক্ষতির জন্য আমরা দায়ী নই; এবং

• সাইট ব্যবহারজনিত কোনো বিষয়ে আপনার প্রতি আমাদের মোট দায় সংশ্লিষ্ট অর্ডারের জন্য আপনার পরিশোধিত অর্থের মধ্যে সীমাবদ্ধ।

বাংলাদেশের আইনে যে দায় বা অধিকার বাদ দেওয়া বা সীমিত করা যায় না — ভোক্তা-অধিকার সংরক্ষণ আইন, ২০০৯ এবং পণ্য বিক্রয় আইন, ১৯৩০-এর অধীন আপনার অধিকারসহ — এবং প্রতারণা কিংবা মৃত্যু বা শারীরিক আঘাতের দায় এই শর্তাবলীতে বাদ যায় না বা সীমিত হয় না।

১৩. অভিযোগ ও বিরোধ নিষ্পত্তি

কিছু ভুল হলে প্রথমে আপনার অর্ডার পেজ থেকে ভেন্ডরের সঙ্গে যোগাযোগ করুন। সন্তুষ্ট না হলে বা ভেন্ডর সাড়া না দিলে আমাদের জানান: [email protected] অথবা 01893-009370। আমরা প্রতিটি অভিযোগ ৭২ ঘণ্টার মধ্যে গ্রহণ-স্বীকার করি, ভেন্ডরের লিখিত জবাব চাই এবং ভেন্ডর প্রকাশিত নীতি ও প্রমাণ ন্যায্যভাবে প্রয়োগ করেছেন কি না তা পর্যালোচনা করি। ভেন্ডরের সিদ্ধান্ত পণ্যের কারিগরি পরীক্ষার ওপর নির্ভর করলে সেই পরীক্ষা করার দায়িত্ব ভেন্ডরের, তবে আমরা ভেন্ডরকে পণ্যটি পুনরায় পরীক্ষা করতে ও কারণ ব্যাখ্যা করতে বাধ্য করতে পারি।

১৪. গোপনীয়তা ও কুকি

আপনার তথ্য আমরা কীভাবে ব্যবহার করি তা আমাদের গোপনীয়তা নীতি ও কুকি নীতি-তে বলা আছে।

১৫. শর্তাবলীর পরিবর্তন

আমরা এই শর্তাবলী হালনাগাদ করতে পারি। হালনাগাদ সংস্করণ প্রকাশের পর করা অর্ডারে প্রযোজ্য হবে। আগে করা অর্ডার সেই সময়ে প্রযোজ্য শর্তেই চলবে। গুরুত্বপূর্ণ পরিবর্তন আমরা সাইটে জানাব।

১৬. প্রযোজ্য আইন

এই শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন দ্বারা পরিচালিত।

১৭. অন্যান্য নীতিমালা এবং কোনটি প্রাধান্য পাবে

এই নীতিমালাগুলো এই শর্তাবলীর অংশ: গোপনীয়তা নীতি, কুকি নীতি, ওয়ারেন্টি নীতি, ফেরত ও রিফান্ড নীতি, ডেলিভারি নীতি, প্রি-অর্ডার নীতি এবং ইউজড ডিভাইস নীতি। কোনো বিষয়ে এদের কোনোটি সুনির্দিষ্টভাবে বললে সেই বিষয়ে ওই নীতি এই সাধারণ শর্তাবলীর ওপর প্রাধান্য পাবে। কোনো নথির ইংরেজি ও বাংলা সংস্করণে অমিল থাকলে বাংলা সংস্করণ প্রাধান্য পাবে।
